Who is liable for big rig accidents in Lancaster, Ohio?

Who is liable for big rig accidents in Lancaster, Ohio?

The trucker could be held responsible. However, there are various other possible parties that could be to blame. There are laws dictating the operation guidelines trucking companies must follow. When those guidelines aren’t upheld, the trucking company can be held liable for a commercial truck accident if:

  • The truck driver has been forced to work more hours than regulations specify
  • The truck driver has been given deadlines causing them to rush
  • The truck driver was hired without proper training or experience to handle the vehicle safely
  • The vehicle’s safety equipment, parts, and computers have not been maintained to ensure safe operations
  • There was not an adequate background check of the truck driver before hiring them
  • The tractor trailers was deliberately overloaded

In some truck accident cases, the semi-truck accident has been caused by truck manufacturer negligence by failing to inform the trucking company that their vehicles had recalls involving parts that critically impacted their safety equipment. Our experienced Ohio truck accident lawyers can help you determine liability.

About Lancaster, Ohio

About Lancaster, Ohio

Incorporation Story:

Colonel Ebenezer Zane of Wheeling founded Lancaster, Ohio on November 10, 1800. Zane was a famous merchant, trailblazer, pioneer and soldier. COL. Zane also was one of the founding members of Zanesville, Ohio, as well as the National Road 40. Following the defeat of the Indians at the Battle of Fallen Timbers in 1794, and the Treaty of Greenville in 1796, settlement within the interior of Ohio became fairly safe from the Indians, and for the first time, legal. Zane, knowing that the interior of Ohio would rapidly expand, wanted to capitalize on this. In 1795, Zane petitioned to Congress the allotment of granting him 3 square miles at the crossing of the Muskingum River, Zanesville, the Hockhocking River, Lancaster, and the Scioto River, Chillicothe. While looking over a track of land on top of Standing Stone, which is now Mt. Pleasant, Zane had located his second location that he was wanting, Lancaster.

The name was originally New Lancaster, as many of the settlers were from Lancaster, Pennsylvania and were wanting to give homage to their original settlement. Majority of the early settlers were of German ancestry including the man from whom the request came, Emanuel Carpenter.

Fairfield County, in which Lancaster is located, was the 8th overall county to be formed in the Northwest Territories. The county was proclaimed by Governor Aruthur St. Clair on December 9, 1800. This location was both the County Seat and the Seat of Justice 3 years before Ohio was formorally made a state. The county then also was quite different, encompassing Delaware, Knox and Licking, and taking large portions of Franklin, Perry, Pickaway and Hocking Counties, consisting of a rough 2,618 square miles. A difference of 2,109 square miles today.

What is Lancaster known for?

Lancaster is home to one of the more controversial Generals of the Civil War, William Tecumseh Sherman. Sherman is most noted as his march on Atlanta, Savannah, and Colombia. May 1864, Sherman set out for the center of the Confederate industry, Atlanta. Here he fought both Confederate Generals Joseph E. Johnston and John B. Hood. Hood was forced to abdicate the city which gave Sherman Atlanta in early September.

Sherman is considered to be controversial due to the records of him burning the city to the ground, though there are arguments among historians saying that retreating Confederate troops did most if not all the destruction. Even though Sheram had a fondness of the South and the people who lived there, he was wanting an end to the war. His strategy was “total war”, bringing devastation to and complete destruction to both military and civilians. Sherman hated fighting, though realized its necessity. He famously said, “ War is cruelty. There is no use trying to reform it. The crueler it is, the sooner it will be over.”

The Fairfield County Fair was first held in the second week of October in 1851. Since then, it has always been the last county fair in Ohio to be held. The fairgrounds hold several refurbished old buildings. Some are: The old Carroll, Ohio, Hocking Valley- C & O Depot – 1871-1966, The Pioneer Cabin – 1803, and most notably The Round Cattle Barn – 1906. Designed and built by J.E. Hedges. Walking through the fairgrounds is like walking through a time capsule. There are a multitude of buildings, barns, and grandstands that have stood the test of time.

Frequently Asked Questions

What happens if the at-fault driver was a semi-tractor trailer?

If you were involved in a Columbus truck accident with a semi-tractor trailer, it is critical that you hire an experienced lawyer to handle this type of personal injury claim. A claim against trucking companies or any other commercial vehicle is handled much differently from a typical automobile claim. A semi-tractor trailer involves a truck driver with a commercial driver’s license and a company that is responsible for that truck driver.

A semi-truck hit me and the truck is from another state. Does that matter?

Oftentimes, semi-truck drivers will travel throughout the country. Many accidents involving semi-trucks involve a truck and/or a driver from a different state. The most important factor is where the accident occurred. Our firm has experience litigating and resolving complex trucking accidents, no matter where the trucking company or driver resides.

I was hurt in an accident involving a semi-truck driver and am having a difficult time communicating with the insurance company for the truck. What do I do?

Some insurance companies will not take your insurance claim seriously if you have not hired a lawyer to represent you. This can be a particular problem when dealing with a commercial insurance policy that covers semi-trucks. If you are having this problem, contact our experienced legal team for a free legal consultation about your trucking accident.

If I am hurt by a semi-truck, how long should I wait before hiring a truck accident lawyer?

With trucking accident cases, the insurance company for the trucking company has their lawyers and investigators meet at the accident scene within minutes of the accident so they can begin gathering evidence and document all of the facts immediately. It is crucial that you hire an experienced attorney as soon as you possibly can following a semi-truck accident. This is the only way you can be on a level playing field.

What is the minimum amount of insurance a trucking company is required to have?

Per the Federal Motor Carrier Safety Act, or FMCSA, trucking companies are required to carry a minimum of $750,000.00 in liability insurance.
